These Terms of Use ("Terms") are a binding agreement between you and MKPBR Global LLC ("MKPBR", "we", "us", or "our"), which operates the website at mkpbr.com and related country-specific pages (the "Site"). By accessing or using the Site, creating an account, or placing an order, you agree to these Terms. If you do not agree, do not use the Site.

We may update these Terms at any time by posting the revised version on this page. Changes take effect when posted; your continued use of the Site after changes are posted constitutes acceptance. Please review this page periodically.

1. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction, if higher) to use the Site or place an order. By using the Site you represent that you meet this requirement.

2. Products & Regulatory Status

MKPBR sells Brazilian personal-care, cosmetic, wellness, and food products. Product descriptions refer to cosmetic, appearance, or general-wellbeing uses only.

No medical claims. Statements about products on the Site have not been evaluated by the U.S. Food and Drug Administration (FDA) and are not intended to diagnose, treat, cure, or prevent any disease, nor to affect the structure or function of the body. Products are not a substitute for professional medical advice; consult a qualified professional before use, especially if you are pregnant, nursing, taking medication, or managing a health condition.
ANVISA (Brazil). Our Brazilian-brand products are sourced in Brazil and are regularized with ANVISA (Agência Nacional de Vigilância Sanitária), Brazil's national health authority, under the applicable regulatory framework for each product category. ANVISA regularization applies to the Brazilian market and is not equivalent to U.S. FDA approval.
Read the label. Product packaging and labeling may be updated by the manufacturer and may differ from the images and text shown on the Site, and may be in Portuguese. Always read the product's label, warnings, and directions before use. If there is any discrepancy, follow the information on the product's label, and contact the manufacturer for labeling questions.
Individual results may vary. Cosmetic and topical products are for external use only; patch test before use and discontinue if irritation occurs.

3. International Orders, Importation, Duties & Title

Origin. Products are sourced and dispatched from Brazil, may be labeled in Portuguese, and are sold for personal use only.
Duties & taxes (prepaid). Applicable import duties and taxes are calculated and collected at checkout, so the price you pay is the final price — no additional payment of those duties and taxes is required to receive your order. These amounts are collected solely for customs-clearance purposes; they are not regulatory fees, and MKPBR does not profit from them.
Importer of record. By purchasing, you are the importer of record. You are responsible for confirming, at the time of purchase, that the product may be lawfully imported and used in your country, and for any costs, obligations, or local-law requirements arising from the importation other than the import duties and taxes we collect at checkout.
Title & risk of loss. Title to and risk of loss for products pass to you upon our delivery of the products to the carrier.
Customs clearance. Shipments are subject to customs clearance in the destination country, which may cause delays beyond our control. Orders that cannot clear customs are addressed under the MKPBR Guaranteed Delivery Program, offered as a courtesy.
Personal use & resale. Products are sold for personal use and are not intended for resale or redistribution. If you resell, redistribute, or otherwise supply the products to third parties, you do so at your own risk and are solely responsible for all resulting obligations — including regulatory compliance, labeling, importation, and product-safety requirements — and you agree to indemnify and hold MKPBR harmless. MKPBR is not responsible or liable for products that have been resold or redistributed.

4. No Representation of Legality Outside Brazil

MKPBR makes no representation that the products, or the Site, are appropriate or lawful for use in jurisdictions outside Brazil, or that these Terms comply with the laws of any other country. Customers outside Brazil access the Site at their own initiative and risk and are responsible for compliance with all applicable local laws and regulations, including import restrictions and any applicable sanctions or export-control rules. Certain products (including intimate-wellness and supplement items) may be restricted or prohibited in your country; you are responsible for confirming local legality before ordering.

5. Pricing & Order Acceptance

All prices are subject to change without notice. Display of a product is an invitation to purchase, not a binding offer; a contract is formed only when we accept your order and charge payment. We may, in our sole discretion, refuse, limit, or cancel any order (including suspected dealer/reseller orders or orders with pricing errors), and may limit quantities per person, household, or order.

6. Authenticity

We sell only authentic products. MKPBR is not responsible or liable for products sold or shipped from unauthorized sources.

7. Accounts & Acceptable Use

You agree to provide accurate, current account and purchase information and to keep it updated. You may not use the Site for any unlawful purpose; transmit malware; scrape, spider, or harvest data; resell or exploit any part of the Site without our written permission; or interfere with the Site's security or operation. We may suspend or terminate access for any violation.

8. User Content

If you submit reviews, comments, or other content, you grant MKPBR a non-exclusive, royalty-free, worldwide license to use, reproduce, edit, publish, and translate it. You are solely responsible for your content, which must not be unlawful, infringing, or misleading. We may, but are not obligated to, monitor or remove content at our discretion.

9. Intellectual Property

The Site and its content, design, and trademarks are owned by MKPBR or its licensors and are protected by law. You receive a limited, personal, non-commercial license to use the Site; no other rights are granted.

10. Third-Party Links & Tools

The Site may link to or provide access to third-party websites, materials, or tools, which we do not control and provide "as is" without endorsement or liability. Your use of them is at your own risk and subject to the third party's terms.

11. Disclaimer of Warranties

The Site, its content, and all products and services are provided on an "as is" and "as available" basis, without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, secure, or error-free. Nothing in these Terms excludes liability that cannot be excluded under applicable mandatory law.

12. Limitation of Liability

To the maximum extent permitted by law, MKPBR and its officers, employees, affiliates, agents, and suppliers shall not be liable for any indirect, incidental, special, punitive, or consequential damages. Our maximum aggregate liability to you for any product, information, or service shall not exceed the amount you paid for that product. Some jurisdictions do not allow certain limitations; in those, our liability is limited to the maximum extent permitted by law.

13. Indemnification

You agree to indemnify and hold harmless MKPBR and its affiliates from any claim or demand, including reasonable attorneys' fees, arising from your breach of these Terms, your misuse of the Site, or your violation of any law or third-party right.

14. Governing Law, Consumer Rights & Time Limit

These Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict-of-laws principles. If you are a consumer, you may also rely, by way of derogation, on the mandatory consumer-protection rights of your country of habitual residence — nothing in these Terms deprives you of those rights. Any claim arising out of or relating to these Terms or the Site must be brought within one (1) year after it arises, except where a longer period is required by mandatory local law.

15. General

These Terms are the entire agreement between you and MKPBR regarding the Site and supersede prior agreements. If any provision is held unenforceable, the remaining provisions stay in effect. We may assign these Terms; you may not. Our failure to enforce any right is not a waiver. Headings are for convenience only.

Addendum A — Consumers in the EEA/UK: Right of Withdrawal

This Addendum applies if you are a consumer resident in the European Economic Area or the United Kingdom and adds to (does not replace) the Terms above. Where it conflicts with the Terms, this Addendum prevails for covered consumers.

14-day withdrawal. You may withdraw from your purchase contract within 14 days without giving any reason. The period expires 14 days after the day you (or a third party you indicate) acquire physical possession of the goods (or the last item, for multi-item orders).
How to withdraw. Inform us of your decision by a clear statement (e.g., email to mkpbr@mkpbr.com) before the period expires. You may use the model form below but it is not required.
Effects. We will reimburse all payments received, including standard delivery costs, within 14 days of being informed, using the same payment method, once we receive the goods back or proof of return. You bear the direct cost of returning the goods.
Hygiene/health exclusion. The right of withdrawal does not apply to sealed goods which are not suitable for return for health-protection or hygiene reasons and were unsealed after delivery (this covers most cosmetics, personal-care, and supplement products), nor to other categories excluded by law.
Mandatory rights preserved. This Addendum does not affect your statutory rights under the mandatory consumer law of your country.
